NFC Terms of Use — Disclaimer & Indemnity

These Terms of Use (“Terms”) govern your purchase and use of NFC stickers, hand tags, and key tags (collectively, “Products”) provided by Profile.me. By purchasing, receiving, or using the Products, you confirm that you have read, understood, and agreed to these Terms.

1. Definitions
• Products: Any NFC-enabled sticker, hand tag, key tag, or similar item supplied by Profile.me.
• We/Us/Our: Profile.me, its affiliates, officers, employees, and agents.
• You/Your: The purchaser, recipient, or user of the Products.

2. Use at Your Own Risk
You are solely responsible for deciding where and how to affix or use the Products. We are not liable for any damage, marking, residue, or difficulty in removing a Product from any surface or device, including but not limited to phone cases, covers, or electronics.

3. NFC Functionality & Security
• The Products rely on third-party devices and operating systems for NFC functionality. We cannot guarantee compatibility with all devices or uninterrupted performance.
• While NFC is generally safe, it can be vulnerable to certain security risks such as redirection, cloning, or tampering. You agree to use the Products responsibly and understand that we do not control how others interact with the NFC link.

4. No Replacement & No Guaranteed Lifespan
• We do not replace Products that are lost, stolen, damaged, scratched, or otherwise altered after delivery, regardless of cause.
• The Products may wear over time depending on how they are handled and environmental factors. We do not guarantee any specific lifespan or performance duration.
• Any replacement, if offered, will be entirely at our discretion and may incur additional costs.

5. Limitation of Liability
To the maximum extent permitted by law:
• We are not liable for any direct, indirect, incidental, special, or consequential loss or damage, including but not limited to device damage, data loss, security breaches, or financial loss, arising from the use or inability to use the Products.
• Our total liability in connection with the Products will not exceed the purchase price paid by you.

6. Indemnity
You agree to indemnify, defend, and hold harmless Profile.me from and against all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your misuse of the Products or breach of these Terms.

7. No Guarantee of Outcomes
The Products are provided “as is” without warranties of any kind, express or implied. We do not guarantee that the Products will lead to increased business, sales, or engagement.

8. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, and any disputes will be subject to the exclusive jurisdiction of the South African courts.

9. Acceptance
By ticking the acceptance box at checkout, completing your purchase, or using the Products, you agree to be bound by these Terms in full.
