Privacy Agreement

  • 1. Introduction
    This Privacy Agreement ("Agreement") outlines the responsibilities and obligations of the administrators ("Administrator(s)") of organisations using the ProfileMe web application platform ("Platform"), owned and operated by ProfileMe Pty Ltd. ("ProfileMe"). This Agreement ensures compliance with the Protection of Personal Information Act (POPIA), as well as other applicable privacy laws and regulations in South Africa.
  • 2. Access and Use of User Information
    Administrators are granted access to view user information and download statistics and lead form submissions in CSV format ("User Information") through the Platform. Administrators agree to use the User Information solely for the intended purposes of managing and overseeing their organisational activities within the Platform and the intended use of lead form submissions. The sale, unauthorised use, or distribution of User Information is strictly prohibited.
  • 3. Data Protection and Security
    Administrators must implement suitable measures to protect and secure User Information against unauthorised access, alteration, disclosure, or destruction. This includes safeguarding the data contained in downloaded CSV files. Administrators agree to comply with all applicable legal, technical, and organisational measures required by POPIA to ensure the security and confidentiality of User Information.
  • 4. Prohibition on Data Sharing
    Administrators are prohibited from sharing User Information and Lead Form submissions with third parties or external entities unless expressly authorised by the user or the person that filled in the lead form or required by law. This includes unauthorised sharing of downloaded CSV files. Any leakage or unlawful dissemination of User Information and lead form submissions will be considered a breach of this Agreement.
  • 5. Indemnification
    Administrators agree to indemnify and hold harmless ProfileMe, its officers, directors, employees, agents, and successors from any claims, losses, damages, liabilities, including legal fees and expenses, arising out of or related to the misuse of User Information and lead form submissions, breach of this Agreement, or violation of any law.
  • 6. Compliance with Laws Administrators are responsible for remaining informed about and compliant with all South African privacy laws and regulations that apply to the collection, use, and safeguarding of User Information.
  • 7. Termination
    ProfileMe reserves the right to terminate an Administrator's access to the Platform should they breach this Agreement or engage in activities that violate applicable laws or regulations
  • 8. Modifications to Agreement
    ProfileMe may modify this Agreement at any time, with changes becoming effective immediately upon posting to the Platform. Continued use of the Platform after such modifications will constitute acceptance of the new Agreement.
  • 9. Governing Law
    This Agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa.
  • 10. Acknowledgement
    By using the Platform, Administrators acknowledge that they have read, understood, and agreed to be bound by this Agreement.
