‘Terms’: Design & Layout priced according to specifications provided, additional design assets will be charged at R580.00 p/hour. All media, services and content produced, provided and distributed by ProfileMe remains the Property and Intellectual Property of ProfileMe and may not be distributed, copied or re-used by any organisation or used for any purposes other than the one(s) originally stipulated in the ProfileMe Service Offering. ProfileMe reserves the right to include the client’s artwork in its marketing material. Once the design has been signed off no changes will be allowed to the design structure. It is the client’s responsibility to check proofs for accuracy in all respects. ProfileMe will not be held liable in any way, financially, legally, or otherwise for: Costs incurred to amend signed-off designs due to, errors, omissions and design variations from the initial Design Briefing; Incorrect changes made to ProfileMe Cards whether by the Subscriber, Employees and Service Providers of ProfileMe, or Unauthorized Users; Service outages preventing access to ProfileMe Cards and services; Materials provided by the client which violate copyright laws. By law ProfileMe is required to adhere to Cease and Desist notices should the client’s content violate copyright laws. Amendments or downtime as a result is for the client’s account. ProfileMe reserves the right to withhold artwork and suspend user access and use of ProfileMe Services without notice and compensation should the client fail to comply with ‘Terms’ or fail to pay the invoiced amount in full. ProfileMe has a no refund policy. By paying the initial deposit or full amount, the client agrees to these ‘Terms’.
